Terms of Service

These terms are the agreement between you and InkSmith. By creating an account or using the service, you agree to them.
1. Acceptance
By accessing or using InkSmith you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the service. If you use InkSmith on behalf of an organization, you confirm you're authorized to bind it.
2. What InkSmith is
InkSmith is an AI-assisted authoring platform that helps you plan, draft, illustrate, review, and research books. It uses third-party AI models to generate text, images, and market research from your prompts and content.
3. Accounts & eligibility
Sign-in is by email (a one-time code or magic link) — there is no password. You're responsible for keeping access to your email account secure and for activity under your account. You must be at least 16 years old (or the age of digital consent where you live) and provide accurate information.
4. Your content and who owns it
You retain ownership of the content you provide ("Inputs") and, as between you and us, of the content the service generates for you from your Inputs ("Outputs"). We claim no ownership of your manuscripts.
You grant us a limited license to host, store, process, transmit, and display your Inputs and Outputs solely to operate and improve the service for you — including sending the necessary parts to our AI providers to fulfil your requests. You are responsible for your Inputs and for ensuring you have the rights to use them.
5. AI-generated content — important
AI Outputs can be inaccurate, incomplete, or unintentionally similar to existing works, and the same prompt can produce different results for different users. You are responsible for reviewing, editing, and fact-checking Outputs before relying on or publishing them.
The legal status and copyright-ability of AI-generated content varies by jurisdiction and may change. We make no warranty that Outputs are original, non-infringing, or protectable, and InkSmith does not provide legal, financial, or professional advice. You are solely responsible for what you publish or distribute.
Outputs are produced from your Inputs at your direction; InkSmith does not review, endorse, or approve them. Before you publish, sell, or share a book made with InkSmith anywhere, you must review and verify it yourself — facts, names, claims, quotations, and legality included. As between you and us, full responsibility for any content you generate with your Inputs and choose to publish rests with you, and to the fullest extent permitted by law InkSmith accepts no liability for it.
6. Acceptable use
You agree not to use InkSmith to:
- break the law or infringe anyone's intellectual-property or privacy rights;
- generate content that is unlawful, that sexualizes minors, that harasses, or that incites violence;
- impersonate others or misrepresent AI Output as human-created where that would be deceptive or unlawful;
- generate real-world operational instructions for serious harm (such as weapons, malware, or drug synthesis), whatever the framing;
- attempt to manipulate, jailbreak, or override the AI's safety and scope instructions (prompt injection), or use the AI for purposes unrelated to writing your book;
- attempt to breach security, scrape at scale, reverse-engineer, or circumvent usage limits or billing;
- resell or sublicense the service itself without our written permission.
We may suspend or terminate accounts that violate these rules, and may remove content we're legally required to remove.
7. Plans, credits & billing
Paid plans and one-time packs are sold through Polar as merchant of record. Subscriptions renew automatically each period until cancelled. Plan token allowances reset at the start of each billing period (use-it-or-lose-it); separately purchased add-on credits remain usable while your subscription is active and pause if it lapses (resuming on resubscribe), while the once-per-account starter packs expire one month after account creation. Founder pricing, where offered, locks the stated rate for as long as the qualifying subscription stays active.
You can manage or cancel your subscription at any time from the billing portal; cancellation stops future renewals and access continues until the end of the current period. Prices may change prospectively — we'll give notice and changes won't affect the period you've already paid for. Refunds are governed by our Refund Policy.
8. Free plan & allowance
New accounts receive a free starting allowance — currently 100,000 tokens — so you can brainstorm, draft, edit, and read a book in the app before paying anything. This free allowance, together with any once-per-account starter packs, is valid for one month from the date you create your account. Exporting a book to a downloadable file (PDF, EPUB, or DOCX) requires a paid plan or a one-time token purchase. Free allowances are provided as-is, may change, and have no cash value.
9. Our intellectual property
The InkSmith platform, software, design, and marks are owned by InkSmith and protected by law. These Terms grant you a limited, non-exclusive, non-transferable right to use the service; they don't transfer our IP to you.
10. Disclaimers
The service is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that Outputs will be accurate or uninterrupted.
11. Limitation of liability
To the maximum extent permitted by law, InkSmith will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the event giving rise to the claim. In particular, InkSmith is not liable for content you generate with your Inputs or for anything you publish, distribute, or sell based on Outputs — that responsibility is yours alone (see sections 5 and 12). Some jurisdictions don't allow these limits, so parts may not apply to you.
12. Indemnity
You agree to indemnify and hold InkSmith harmless from claims arising out of your Inputs, your Outputs, your use of the service, or your breach of these Terms or of someone else's rights.
13. Termination
You can stop using InkSmith and delete your account at any time. We may suspend or terminate access for violations of these Terms or to comply with law. On termination, your right to use the service ends; sections that by their nature should survive (ownership, disclaimers, liability, indemnity) will survive.
14. Governing law & disputes
These Terms are governed by the laws of [GOVERNING-LAW JURISDICTION], without regard to conflict-of-laws rules. The courts located there have exclusive jurisdiction, unless mandatory local law gives you the right to bring a claim elsewhere.
15. Changes to these Terms
We may update these Terms; we'll revise the "last updated" date and, for material changes, give notice. Continuing to use InkSmith after changes take effect means you accept the updated Terms.
